Terms of Service

Important: These terms include a binding arbitration agreement and a waiver of liability for in-person and live fire training activities. Please read carefully before enrolling.

1. Acceptance of Terms

About this platform: Secureburg Academy ("Company", "we", "us", or "our") is an online course delivery platform. The training courses available on this platform are created and delivered by independent, DPS-licensed Texas security training companies ("Training Providers"). Secureburg Academy is not itself a DPS-licensed training provider. Certificates of completion are issued by the relevant Training Provider, not by Secureburg Academy.

By creating an account, registering for, or enrolling in any course available through the Secureburg Academy platform, you ("Student", "you", or "your") agree to be bound by these Terms of Service, our Privacy Policy, and all applicable federal and Texas state laws.

By checking the agreement box at registration and clicking "Register", you confirm that:

  • You have read, understood, and agree to these Terms of Service in their entirety.
  • You have read and agree to our Privacy Policy.
  • You are at least 18 years of age.
  • You accept the Assumption of Risk and Waiver of Liability described in Section 11 as it applies to any in-person or live fire training activities.

It is your responsibility to read these Terms before registering. Ignorance of these Terms does not exempt you from their obligations. If you do not agree to all of these terms, you must not create an account or use our platform. Your continued use of our services after any updates constitutes ongoing acceptance of the revised terms.

2. Eligibility

You must be at least 18 years of age and hold a valid Texas security officer license (or be actively pursuing one) to enroll in our Level III recertification courses. You represent and warrant that all information you provide during registration is accurate, current, and complete. You are solely responsible for ensuring you meet all Texas Department of Public Safety (DPS) prerequisites before enrolling. Secureburg Academy reserves the right to verify eligibility and to deny or revoke enrollment if eligibility requirements are not met.

3. Enrollment and Payment

  • Enrollment is confirmed upon successful payment. You will receive a confirmation email with access instructions.
  • All prices are listed in US dollars and are subject to change without notice. Prices at the time of purchase are honored.
  • Payments are processed securely through Braintree and PayPal. Secureburg Academy does not store your payment card details.
  • Sales tax may apply depending on your location and is your responsibility.
  • Chargebacks or payment disputes initiated without first contacting us may result in immediate account suspension.

4. Refund Policy

We want you to be confident in your enrollment. Our refund policy is as follows:

  • Refund requests submitted within 7 days of purchase and before completing more than 20% of the course content will be honored in full.
  • No refunds will be issued after 7 days or once more than 20% of the course has been completed.
  • In-person practical training sessions and live fire range qualifications are non-refundable once attended.
  • Secureburg Academy reserves the right to refuse a refund if abuse of the refund policy is suspected.

5. Course Access

  • Online course content is available 24/7 upon enrollment and can be completed at your own pace.
  • In-person practical training sessions are scheduled separately and require prior registration for a specific date and location.
  • Access to online course materials is provided for a minimum of 12 months from the date of enrollment.
  • You may not share your account credentials or course access with any other person.
  • We reserve the right to suspend access for violations of these terms without refund.

6. Free Exam Retakes

Students who do not pass the final exam on their first attempt are entitled to free retakes until they achieve a passing score, provided they are still within the active enrollment period. Retake eligibility does not extend beyond the enrollment period and does not apply to in-person practical assessments or live fire range qualifications.

7. Certification and DPS Requirements

Completing a course through the Secureburg Academy platform, delivered by a DPS-licensed Training Provider, is intended to fulfill the applicable training requirements for Texas security officer certification or recertification. The DPS license to conduct that training is held by the Training Provider, not by Secureburg Academy. Final license renewal is processed directly through the Texas Department of Public Safety (DPS). Secureburg Academy is not responsible for any delays, denials, additional requirements, or outcomes imposed by DPS or the Training Provider. It is solely your responsibility to submit your renewal application to DPS in a timely manner and to comply with all applicable DPS regulations.

8. Acceptable Use

You agree not to:

  • Share, reproduce, or distribute any course content without written permission.
  • Attempt to circumvent or manipulate any exam or assessment.
  • Use the platform for any unlawful purpose.
  • Impersonate another student, instructor, or representative of Secureburg Academy.
  • Engage in any conduct at in-person training sessions that is unsafe, threatening, or disruptive.
  • Bring prohibited items to any training facility, including but not limited to unauthorized firearms or weapons.

Violation of these terms may result in immediate removal from the training session and termination of your account without refund.

9. Intellectual Property

Intellectual property on this platform belongs to two distinct parties:

  • Platform and branding — the Secureburg Academy name, logo, platform software, interface design, and proprietary features are the sole intellectual property of Secureburg Academy, protected by United States copyright and trademark laws.
  • Course content — all training materials, lesson content, assessments, videos, and documents within each course are the intellectual property of the Training Provider that created and delivers that course. Secureburg Academy does not claim ownership of Training Provider content.

Your enrollment grants you a limited, personal, non-transferable, non-exclusive license to access the course content for your own certification or recertification use only. Any unauthorized reproduction, distribution, or commercial use of either platform materials or course content is strictly prohibited and may result in legal action by the respective rights holder.

10. Health, Fitness, and Medical Acknowledgment

By enrolling in any in-person practical training or live fire range session, you represent and warrant that:

  • You are in adequate physical and mental health to safely participate in defensive tactics, baton work, handcuffing, and live fire range activities.
  • You do not have any medical condition, disability, or impairment that would make participation unsafe to yourself or others without prior written clearance from a licensed physician.
  • You will immediately notify your instructor of any medical concern that arises before or during training.
  • You understand that physical training activities carry inherent risk of injury, and you accept responsibility for disclosing any relevant health information prior to participation.

Secureburg Academy and the Training Provider each reserve the right to remove any participant from a session at any time if, in the sole judgment of the Training Provider's instructor, participation poses a risk to health or safety.

11. Assumption of Risk and Waiver of Liability

Please read this section carefully. It affects your legal rights.

Voluntary Participation. You acknowledge that your participation in any in-person practical training, defensive tactics instruction, baton and restraint exercises, and live fire range qualification (collectively, "Physical Training Activities") is entirely voluntary.

Assumption of Risk. You expressly acknowledge and assume all risks — known and unknown, foreseen and unforeseen — associated with Physical Training Activities, including but not limited to: physical injury, bodily harm, property damage, firearm-related incidents, accidents resulting from the actions of other participants, and any other hazards inherent in security officer training and firearms qualification.

Waiver and Release. To the fullest extent permitted by Texas law, you hereby waive, release, and forever discharge Secureburg Academy, the Training Provider whose course you are enrolled in, and each of their respective owners, officers, directors, employees, agents, independent contractors, and instructors (collectively, "Released Parties") from any and all claims, demands, damages, causes of action, losses, or liabilities — whether based on negligence or otherwise — arising from or related to your participation in Physical Training Activities.

Indemnification of Released Parties. You agree that this waiver and release is binding upon your heirs, personal representatives, estate, and assigns. You understand that you are giving up substantial rights, including the right to sue for injuries sustained during Physical Training Activities.

Online Course Limitations. This waiver does not apply to claims arising solely from the online course platform unrelated to Physical Training Activities.

12. Indemnification

You agree to indemnify, defend, and hold harmless Secureburg Academy, the Training Provider whose course you are enrolled in, and each of their respective owners, officers, directors, employees, agents, and instructors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your negligence, misconduct, or willful acts during any training activity; (c) your violation of any applicable law or regulation; (d) any misrepresentation you make regarding your eligibility, health, or qualifications; or (e) any third-party claim arising from your conduct.

13. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SECUREBURG ACADEMY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. SECUREBURG ACADEMY MAKES NO GUARANTEE THAT COMPLETION OF ANY COURSE WILL RESULT IN LICENSE RENEWAL, DPS APPROVAL, OR EMPLOYMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE TEXAS AND FEDERAL LAW, SECUREBURG ACADEMY AND ITS RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.

IN NO EVENT SHALL SECUREBURG ACADEMY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS EXCEED THE AMOUNT YOU ACTUALLY PAID TO SECUREBURG ACADEMY IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Dispute Resolution and Binding Arbitration

Informal Resolution First. Before initiating any formal dispute, you agree to contact us at support@secureburg.com and allow us 30 days to attempt to resolve the matter informally.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Waiver of Class Actions. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive your right to participate in any class action lawsuit or class-wide arbitration.

Small Claims Exception. Either party may bring an individual claim in a small claims court of competent jurisdiction in Texas as an alternative to arbitration.

16. Force Majeure

Secureburg Academy shall not be held liable for any failure or delay in performance of its obligations arising from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, extreme weather, government orders or regulations, public health emergencies, facility closures, power outages, or civil unrest. In such events, we will make reasonable efforts to reschedule in-person sessions and maintain online course availability.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Texas.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. Changes to These Terms

We reserve the right to update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. We will notify enrolled students by email of any material changes. Continued use of our platform after changes are posted constitutes acceptance of the revised Terms.
